Se ordenó inaplicar el numeral 2 del Art. 1º del Decreto 1382 del 2000 por ser inconstitucional.
En este orden de ideas, se resolvió el conflicto de competencias planteado entre el Tribunal Administrativo de Santander y la Corte Suprema de Justicia, Sala Civil, en el sentido de remitir el expediente a la primera de las citadas Corporaciones, para que resuelva de fondo la acción de tutela de la referencia, de conformidad con lo dispuesto en el Art. 86 de la C.P. y el Art. 37 del Decreto 2591 de 1991.
